Welcome to Coppertack! The terms "we," "us," and "our" refer to Coppertack Leather ("Coppertack"). Coppertack operates this store and website, including all related information, content, features, tools, products, and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Coppertack is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy and Refund Policy. If you do not agree to these Terms of Service, our Privacy Policy, or our Refund Policy, you should not use or access our Services.

Section 1 - Access and Account

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.

To use the Services, including accessing or browsing our online store or purchasing any of the products we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide is correct, current, and complete, and that you have all rights necessary to provide this information.

Section 2 - Our Products

Every item we sell is handcrafted from genuine cowhide leather, a natural material. Please note:

  • Colors, grain, and texture may differ from how they appear on your screen due to your device's display settings, and leather naturally varies from hide to hide. Natural markings, grain variation, and slight color differences are normal characteristics of the material and are not defects.
  • We do not warrant that the appearance of any product you receive will be identical to the images shown in our store. Every item is individually hand-inspected for quality and beauty before it ships.
  • All product descriptions are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time and may limit quantities available.

Section 3 - Orders

When you place an order, you are making an offer to purchase. Coppertack reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Coppertack confirms acceptance. We must receive and process your payment before your order is accepted.

Because each item is handcrafted, please review your order carefully — including any personalization or engraving details — before submitting. Engraved or personalized items cannot be modified or cancelled once production has begun, and we may be unable to accommodate cancellation requests on any order shortly after it is placed.

Your purchases are subject to return, exchange, or warranty solely in accordance with our Refund Policy, which is incorporated into these Terms by reference.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export, unless otherwise agreed to by Coppertack in writing.

Section 4 - Lifetime Warranty on Fabrication

Coppertack stands behind its craftsmanship. Every item includes a lifetime warranty against genuine fabrication defects — issues arising from how the item was constructed, such as a failed stitch or defective rivet setting.

This warranty does not cover normal wear and aging of the leather, damage caused by abuse or misuse, lost or stolen items, or vandalism. Full details, including how to submit a warranty claim, are available in our Refund Policy.

Section 5 - Prices and Billing

Prices, discounts, and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed, as set out in your order confirmation email. Unless otherwise stated, posted prices do not include taxes, shipping, handling, customs, or import charges. Georgia sales tax will be applied where required by law.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases. You represent and warrant that (i) the payment information you provide is true, correct, and complete, (ii) you are duly authorized to use the payment method provided, and (iii) you will pay all charges incurred at the posted prices, including shipping and applicable taxes.

Section 6 - Shipping and Delivery

We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you. If your item arrives damaged in transit, please refer to our Refund Policy for next steps.

Section 7 - Intellectual Property

Our Services, including but not limited to all trademarks, brand elements, text, images, product photography, and the design and arrangement thereof, are owned by Coppertack and are protected by U.S. patent, copyright, trademark, and other intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material from the Services without our prior written consent. All rights not expressly granted are reserved by Coppertack.

The Coppertack name, logo, and product designs are trademarks of Coppertack. You must not use them without our prior written permission. Shopify's name, logo, and related marks are trademarks of Shopify. All other names, logos, and marks appearing on the Services are the property of their respective owners.

Section 8 - Optional Tools

You may be provided access to tools offered by third parties as part of the Services, which we neither monitor nor control. We provide access to such tools "as is" and "as available," without any warranties or endorsement, and we have no liability arising from your use of them. Any use of optional third-party tools is entirely at your own risk.

Section 9 - Third-Party Links

The Services may contain links to websites operated by third parties. We are not responsible for examining or evaluating the content or accuracy of any third-party materials, and we are not liable for any harm related to your access of any third-party site. Please review the third party's own policies before engaging in any transaction with them.

Section 10 - Relationship with Shopify

Coppertack is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Coppertack. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Coppertack.

Because the Services are hosted by Shopify, Shopify also collects and processes personal information about your access to and use of the Services. If you submit any ideas, suggestions, reviews, or other feedback ("Feedback") to us, you grant us a perpetual, worldwide, royalty-free license to use, reproduce, and display such Feedback for any purpose, including promoting Coppertack. You represent that you own or have the rights to submit such Feedback, and that it will not violate any third party's rights or contain unlawful, abusive, or infringing content. We are under no obligation to keep Feedback confidential, compensate you for it, or respond to it.

Section 13 - Errors, Inaccuracies, and Omissions

Occasionally there may be information on the Services that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, shipping charges, or availability. We reserve the right to correct any such errors and to change, update, or cancel orders at any time without prior notice, including after an order has been submitted.

You may access and use the Services for lawful purposes only. You agree not to:

  • Use the Services for any unlawful or malicious purpose, or to violate any applicable law or regulation
  • Infringe upon our intellectual property rights or those of others
  • Harass, abuse, or harm any Coppertack employee or other person

  • Impersonate any other person or entity
  • Upload viruses or other malicious code
  • Reproduce, duplicate, copy, extract, resell, or exploit any portion of the Services without our consent
  • Use bots, scrapers, automated data-gathering tools, or AI agents to access the Services, except as expressly permitted in Section 15 below
  • Interfere with, bypass, or circumvent any security or access-control measures we employ

We reserve the right to suspend, disable, or terminate your access to the Services at any time, without notice, if we determine you have violated these Terms.

Section 15 - Agents

This section applies if you use, allow, enable, or cause the deployment of an automated "Agent" (any software that takes autonomous or semi-autonomous action on your behalf) to access, use, or interact with the Services.

No Agent may access, use, or interact with the Services unless it: (i) identifies itself as an Agent in all requests, including in the request's user agent string; (ii) does not conceal that its access, use, or interactions are automated, including by mimicking human behavior or bypassing measures intended to distinguish human from automated use; (iii) responds truthfully to any prompt seeking to determine whether it is human or automated; and (iv) does not circumvent any measure intended to control Agent access to the Services. We may limit, by technical or other means, whether and how any Agent accesses the Services.

We may terminate this agreement or your access to the Services, in our sole discretion, at any time without notice, and you will remain liable for all amounts due up to the date of termination.

The following sections survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive.

Section 17 - Disclaimer of Warranties

The information presented on the Services is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information, and any reliance you place on it is at your own risk.

EXCEPT AS EXPRESSLY STATED IN OUR LIFETIME FABRICATION WARRANTY AND REFUND POLICY, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU.

Section 18 - Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO CASE SHALL COPPERTACK, ITS OWNER, OR ITS AGENTS, CONTRACTORS, OR SERVICE PROVIDERS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS OR LOST DATA, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT PURCHASED THROUGH THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ALL CASES, COPPERTACK'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR PURCHASE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

Section 19 - Indemnification

You agree to indemnify, defend, and hold harmless Coppertack, Shopify, and their respective affiliates, agents, contractors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys' fees, arising out of (1) your breach of these Terms, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.

Section 20 - Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the unenforceable portion shall be severed, without affecting the validity of the remaining provisions.

Section 21 - Waiver; Entire Agreement

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Coppertack regarding your use of the Services, superseding any prior agreements or communications.

Section 22 - Assignment

You may not delegate, transfer, or assign these Terms or your rights or obligations under them without our prior written consent. We may transfer, assign, or delegate these Terms and our rights and obligations without notice to you.

Section 23 - Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. You and Coppertack consent to the exclusive jurisdiction and venue of the state and federal courts located in Georgia for any dispute arising from these Terms or your use of the Services.

Section 24 - Headings

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Section 25 - Changes to Terms of Service

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates to our website. It is your responsibility to check this page periodically for changes. Your continued use of the Services following the posting of any changes constitutes acceptance of those changes.
